Former Minnesota governor sues TSA over airport pat-down

St. Paul, MN, United States (AHN) – Former Minnesota Gov. Jesse Ventura is suing the Department of Homeland Security and the Transportation Security Agency for subjecting him to airport pat downs that he maintains violate his constitutional rights.

Lawyers for Ventura, 59, filed a lawsuit on Monday in the U.S. District Court for the District of Minnesota. The suit accuses the two agencies and their respective heads, Homeland Security Sec. Janet Napolitano and TSA Administrator John Pistole, of violating his Fourth Amendment rights to be free from unreasonable searches and seizures.

Ventura, who was known as “The Body” during his days as a professional wrestler, had his hips replaced with a titanium implant in 2008. Since then, the suit said, he has had to submit to extra security screening at airports because he sets off metal detectors. According to the complaint, until last year he was only asked to undergo a non-invasive magnetic hand-wand inspection.

In November, however, Ventura was subjected to a pat-down after he set off the metal detector at the Minneapolis-St. Paul International Airport.

Once he was directed to undergo additional screening, “[Ventura] was not free to leave the airport security area or to decline his scheduled flight to avoid additional screening, which is a seizure of person, and he was subjected to a pat-down body search, which is a search of of his person,” the lawsuit said.

Under TSA’s policy, pat-downs are conducted after checkpoint alarms and if a person opts out of a full-body scan.

Ventura said he has traveled on hundreds of commercial flights nationwide in the past four decades, including recent thrice-a-week flights to film his television show. He said the pat-downs he was subjected to and will have to undergo in future flights meet the definition for unlawful sexual assault under Minnesota law.

He added that since he will be chosen for random or suspicion-based pat-downs or whole body imaging machines, the body scans he will have to repeatedly undergo meet the definition of unlawful video voyeurism under federal law.

After hearing an audio clip of a voice verification process, three-fifths of the respondents were likely to use voice verification as a form of security. Sixty-one percent of respondents feel that voice verification is a secure form of identity verification for phone access to customer service data. And eighty-three percent of respondents agreed that institutions should require different forms of identity verification based on the types of transactions.

Voice verification is conceptually similar to fingerprinting. It is common knowledge that each person’s fingerprints have unique characteristics that can be used to distinguish one person from another. It has also been proven that each person can be identified by the unique features of his or her vocal characteristics and speaking patterns. Voice verification confirms a customer’s identity by comparing a caller’s voiceprint to an earlier digitized recording. This new application ensures that the person requesting payments or other services is the same customer who began doing so in the first place. Without third party verification services as another method of security, things would be more susceptible to breakage and other dangers.
